Spelbound declared winner of Britain’s Got Talent 2010

Monday, June 7, 2010

An acrobatic group known by the name of Spelbound has been declared as the winner of Britain’s Got Talent 2010, a televised variety talent show competition broadcast on ITV in the United Kingdom. As the winning act of the show, Spelbound have won £100,000 (US$144,580, 120,313, A$175,079) and a place at The Royal Variety Performance, an annual gala evening that is attended by senior members of the British Royal Family.

In no particular order, the top three acts were revealed to be two dancers known by their stage name of Twist and Pulse, gymnastic group Spelbound and Kieran Gaffney, whose act involves playing on the drum kit. After Kieran Gaffney was revealed to be in third place, Anthony McPartlin, who hosts Britain’s Got Talent with Declan Donnelly, said to Kieran: “Well done Kieran. Kieran, you’re a star, you came back, you got all the way to the final. I know you’ve loved this. You’ve loved this, haven’t you?” In response to this, Kieran Gaffney stated: “Thank you very much. Thank you, everyone for supporting me. Thank you.”

Shortly afterwards, on the episode that was broadcast live on ITV1 on Saturday, Anthony announced: “After tens of thousands of auditons, five semi-finals and an amazing final, this…this is it. One of you is about to walk away with £100,000 and a place at this year’s Royal Variety Performance. The winner of Britain’s Got Talent 2010 is…Spelbound!” Glen Murphy from Twist and Pulse commented about finishing in second place, stating: “Yeah, it’s amazing. I can’t even believe it. I can’t believe it at all.”

Alex Uttley, a 24-year-old member of Spelbound, commented on the gymnastic group’s victory, commenting: “Oh, my god. This is unbelieveable. We just want to say thank you to everyone out there. It just shows that all our hard work has paid off.” One of the coaches of Spelbound, named Neil Griffiths, stated about Spelbound: “Oh, they’ve worked so hard over the last few weeks. Um, since the semi-final, we…we really had to pull out the stops to try and up the game. They’ve not known they’ve worked in the gym from six in the morning till twelve…twelve o’clock of the night. I couldn’t have asked for more. Um, it’s a team of coaches. I don’t take all the credit myself. There’s, uh, two people up there that know who they are who’ve been fantastic.”

Spelbound consists of 24-year-old Alex Uttley, Nicholas Illingworth, aged 24, Adam Buckingham, aged 21, 20-year-old Adam McAssey, 19-year-old Douglas Fordyce, 18-year-old Edward Upcott, 18-year-old Leighanne Cowler, 17-year-old Katie Axten, 17-year-old Lauren Kemp, 15-year-old Jonathan Stranks, Abigail Ralph, aged 15, 13-year-old Hollianne Wood and Amy Mackenzie, aged 12. Bookmakers had previously predicted that Spelbound would be the most likely act to become the winner of the series.

The running order for the final started with Twist and Pulse. The second act to perform was Liam McNally, a 14-year-old singer. The running order subsequently continued with 40-year-old impressionist Paul Burling, singer Christopher Stone, aged 28, Tina & Chandi, a woman and dog dancing act, Connected, a five-piece singing group, Kieran Gaffney, aged 12, 22-year-old Tobias Mead, a dancer, 80-year-old singer Janey Cutler and Spelbound in that particular order.

Earlier on in the final, Britain’s Got Talent judge Amanda Holden has stated to Spelbound: “We are hosting the 2012 Olympics and I think ‘what a brilliant opening act’.” Fellow judge Piers Morgan also commented that “[t]he purpose of this show is to identify hidden great British talent. You are that act.” After Spelbound won in the final, another judge, named Simon Cowell, stated that “the right boys and girls won on the night” and that he could “only say on live TV that that was one of the most astonishing things I have ever seen. Seriously.”

Too Grimm? Mother Goose cartoonist sued by Colombian coffee growers

Sunday, January 11, 2009

While it was just a joke, the Federación Nacional de Cafeteros de Colombia doesn’t find a recent “Mother Goose and Grimm” comic terribly funny.

In what the coffee growers association calls “an attack on national dignity and the reputation of Colombian coffee,” the characters in a comic strip by Pulitzer Prize-winning cartoonist Mike Peters call into question the relationship of Colombian coffee growers and the crime syndicates of Columbia.

The cartoonist is being sued not only for “damages [to] the intellectual heritage” of the coffee, but also “moral compensation. A public manifestation,” to the tune of $20 million.

At the start of a week-long series of strips, a dog character named “Ralph” finds out that part of chemist and food storage technician Fred Baur‘s remains was buried in a Pringles can, upon his last wishes. Baur’s best known innovation, among multiple, was the patented can and packing method for the Pringles potato chip. The character theorizes what other remains might be interred in their food packaging. Eventually, the dog states that “when they say there’s a little bit of Juan Valdez in every can, maybe they’re not kidding.” This play on an old advertising slogan refers to fictional character Juan Valdez, created by the Federación Nacional.

In a statement Peters says:

I had no more thought to insult Colombia and Juan Valdez than I did Pringles, Betty Crocker, Col. Sanders, Dr. Pepper and Bartles & Jaymes. The cartoon is meant to be read along with the rest of the week as a series of which the theme is based on the fact that the inventor of the Pringles can had his ashes buried in one.

I thought this was a humorous subject and all of my Mother Goose & Grimm cartoons are meant to make people laugh. I truly intended no insult.

Julio Cesar Gonzalez, El Tiempo newspaper’s famous cartoonist, told the BBC that the lawsuit is “a real waste of time.”

In 2006, the Federación Nacional sued Café Britt over their advertising campaign titled “Juan Valdez drinks Costa Rican coffee. In a counter-suit, Britt presented an affidavit from a Costa Rican man named “Juan Valdez”, acknowledging that he drinks Costa Rican coffee, and that the name is too generic to be exclusive. A variety of legal challenges and charges from both sides were eventually dropped. The phrase was actually first used in a 1999 speech by Jaime Daremblum, then-Costa Rican ambassador to the United States.

Mother Goose and Grimm appears in over 800 newspapers worldwide; Peters has won the Pulitzer for his editorial cartoons for the Dayton Daily News. Thirty years ago, his editorial cartoon about electricity prices featured Reddy Kilowatt, an electricity generation spokescharacter. The Daily News defended that comic image in the United States Supreme Court, winning on the basis that “the symbol was not selling a product”, and thus the satire was legally permissible.

Peters drinks Colombian coffee.

Romanian tourism to be rebranded

Friday, May 6, 2005

Romania’s National Authority for Tourism (ANT) announced that they would promote tourism in Romania through a new branding strategy, in collaboration with the United States Agency for International Development. The director of ANT, Marius Critonescu, said that the branding exercise will be “a significant component of the Romania’s development as a new tourist destination of international level.” He also added that the development of an integrated brand for Romanian tourism will promote a more positive image for the country, thereby increasing the number of tourists and investors. In recent times, there has been quite a lot of investment in “national branding”, especially in the field of tourism, as most marketing experts believe that branding for a product or a country is theoretically the same thing, and that the same strategies and approach should be used for both.

Concerning the Romanian tourism rebranding, international tourism and marketing expert James MacGregor stated that, “We have to touch the hearts and souls of the contemporary tourists who no longer travel for a simple beach or ski track. They want to live a self-knowledge experience that is truly uplifting and will leave unforgettable memories. The brand must show them not what they will see or do as tourists but what they will feel when visiting Romania.”

Question: 1

Which of the following is not considered to be a security, as defined by the Uniform Securities?

Act (USA)?

A. a debenture

B. a certificate of deposit (CD)

C. a put option

D. an annuity contract wherein an insurance company promises to pay a fixed sum, either in a lump

amount or through periodic payments.

Answer: D

Explanation: The Uniform Securities Act excludes annuity contracts wherein an insurance company

promises either to pay a fixed sum, either in a lump amount or through periodic payments, from its

definition of a security. Debentures, CDs, and option contracts are all classified as securities unde

the USA.

Question: 2

A variable annuity is:

A. not a security and, therefore, does not have to be registered with the state.

B. not a security, but is still required to be registered with the state before it can be offered for sale.

C. a security and, therefore, has to be registered with the state before it can be offered for sale.

D. a security, but is exempt from state registration.

Answer: D

Explanation: A variable annuity is defined as a security, but is exempt from state registration in the

opinion

of the North American Securities Administrators Association (NASAA.) The Supreme Court of the U.S.

passed a ruling that deemed a variable annuity to be a security. The National Securities Market

Improvement Act of 1996 (NSMIA) established variable annuities to be federal covered securities,

however, since they are, for all intents and purposes, mutual funds. Federal covered securities are

exempt from state registration.

Question: 3

In its prospectus, the YourMoney Mutual Fund provides charts and tables of its average annual

eturn

over the past year, three years, five years, and ten years. The fund’s return has indeed been

phenomenal

over this time period, beating the S&P 500 Index by at least 15%. The prospectus states that this is

ecause the fund invests in securities that are riskier and that, therefore, an investor can expect the

fund

to continue earning a return higher than the S&P 500 Index. Is YourMoney guilty of any security

violations?

A. Question: YourMoney properly revealed to prospective investors the fact that its higher than average

eturns

are the result of its investment in riskier securities.

B. Yes. There is no way the fund could have beaten the S&P 500 Index by at least 15% over the past

ten

years. The fund is obviously misstating its returns.

C. Yes. YourMoney is guilty of fraud in claiming that “an investor can expect the fund to continue

earning

a return higher than the S&P 500 Index.” Past performance is no indication of future performance.

D. Question: Regulations require only that the mutual fund provide charts and tables of its average annual

eturns, with a statement comparing the fund performance with a relevant market index.YourMoney

has

done this and more.

Answer: C

Explanation: Yes. YourMoney is guilty of fraud in its claim that “an investor can expect the fund to

continue earning a return higher than the S&P 500 Index.” Past performance is no indication of futu

e

performance, and this statement is clearly a misstatement of a material fact. In fact, because the

securities the fund invests in are riskier than average, the fund returns can be expected to fall harde

than

the S&P 500 Index in a market downturn.

Question: 4

You are an investment adviser to Mr. Crochety, an elderly man who lives solely on his social

security

income although he managed to accumulate an investment portfolio worth about $100,000 over the

years.

Mr. Crochety recently got his hands on a business publication and read about the tax-free interest

paid by

municipal bonds. He calls you and instructs you to sell his other investments and invest all his money

in a

municipal bond portfolio, so that “the government doesn’t get any more of my hard-earned money.”

You

tell Mr. Crochety that you don’t believe this is a wise move because he’s in such a low tax bracket

that

municipal bonds are not a good investment for him, but he is insistent. Based on these facts, you

should

A. ignore Mr. Crochety’s instruction since it is not in his best interest.

B. require Mr. Crochety to sign an affidavit of liability waiver, indicating that you will not be held

esponsible for any adverse consequences of this decision.

C. have Mr. Crochety sign a statement of investment policy that indicates that this transaction is

eing executed on the client’s instructions and that you have advised the client against it.

D. call Mr. Crochety’s relatives and suggest they have him examined for mental instability.

Answer: C

Explanation: Given that you have advised Mr. Crochety that this is not a wise move and he still insists

on it,

you should protect yourself by getting it in writing. In no case, however, can you require a client to

sign an

affidavit of liability waver, nor can you refuse to follow his adamant instructions.

Question: 5

Harry Lange manages the investment portfolio for the Fidelity Magellan Mutual Fund. Mr.

Lange is a(n)

A. broker-dealer.

B. agent.

C. investment adviser.

D. investment company.

Answer: C

Explanation: If Harry Lange is managing the investment portfolio of Fidelity Magellan Mutual Fund, he

is

an investment adviser. He is making the investment decisions and receives a percentage of the assets

under management as his compensation. He is not selling the mutual fund or the fund’s investors

anything, which is the job of a broker-dealer or an agent. Fidelity Magellan is the investment

company.

Question: 6

Mr. Bigwig, CEO of HiGrowth Corporation, meets with the president of BigFee Investment

Bankers and

arranges for BigFee to underwrite an Initial Public Offering (IPO) for the firm. When the IPO comes to

market, GetErDone Broker-Dealers is part of the selling group, which handles the sale of the stock to

the

public. In this scenario, which party is the issuer?

A. HiGrowth Corporation

B. Mr. Bigwig

C. BigFee Investment Bankers

D. GetErDone Broker-Dealers

Answer: A

Explanation: HiGrowth Corporation is the issuer in this instance. Its stock will be sold, and HiGrowth

will

eceive the proceeds from the sale-less BigFee’s underwriting spread. Mr. Bigwig is merely

HiGrowth’s

epresentative in this instance.

Question: 7

Joe Treader is the owner of a small, state-registered investment advisory firm that is on the

verge of

ecoming insolvent. One of his clients who has become like a mother to him is aware of his financial

difficulties and has offered to sell off some of the assets that he manages for her and loan him the

money

to get him through this period of economic

uncertainty until he is able to get on his feet again. Can Joe take her up on her offer?

A. Yes. Based on the facts presented, it is an unsolicited offer and, as such, Joe can (and should)

accept

it.

B. Yes, but only if Joe draws up a formal loan agreement with a fair interest rate, based on the going

market rates, stated in the agreement as well as a firm date for principal repayment.

C. Question: As the client’s investment adviser, he has a fiduciary relationship with the client. Entering a

loan

agreement with this client could lead to conflicts of interest.

D. Both A and B are true.

Answer: C

Explanation: No, Joe cannot take his client’s offer of a loan because it could lead to a conflict of

interest–if

not today, perhaps in the future–and as a fiduciary Joe will be expected to put this client’s welfare

ahead

of his own. If it takes him a lot longer than expected to get on his feet again, he may be tempted to

act in

his own best interest.

Question: 8

Shady Corporation’s executives are concerned over the firm’s steadily declining stock price and

decide to

do something about it. They each decide to make significantly large purchases of their firm’s stock in

order to stabilize and hopefully even to drive up its price, reasoning that they can sell the stock fo

the

higher price down the road and profit from the transaction. You are a broker-dealer for the firm’s

executives. Are Shady’s executives planning to do anything illegal?

A. Question: It’s a win-win. They are using their own money to buy stock of their firm, and this can help

drive the

stock price up and put profits in their pockets.

B. Yes. To purchase shares of their own company is considered to be illegal insider trading.

C. Question: As long as they follow the rules and report their purchases to the SEC, it is not illegal for them

to

purchase shares of their firm’s stock.

D. Yes. Although it is not illegal for them to purchase shares of their firm’s stock, they cannot do so in

order to try to manipulate the price of the stock.

Answer: D

Explanation: Yes. Although it is not illegal for Shady’s executives to purchase shares of their firm’s

stock,

in this case they are planning to do something illegal in deciding to make significantly large purchases

of

their firm’s stock in order to manipulate the price. This is an example of price pegging.

Question: 9

Which of the following would a firm not be expected to provide to the Administrator when

egistering an

issue of securities with the state?

A. all sales and advertising materials that will be used in conjunction with the offering.

B. the agreement between the issuing firm and the underwriters

C. the agreement among the underwriters themselves

D. The firm will be expected to provide all of the above to the Administrator when registering an

issue of

securities with the state.

Answer: D

Explanation: The firm will be expected to provide all of the above-sales and advertising materials to

e

used in the offering, the agreement between the issuing firm and its underwriters, and the

agreement

among the underwriters themselves.

Question: 10

Under the 2002 Uniform Securities Act, registration by coordination allows:

A. federal covered securities to be registered simultaneously with the SEC and with the states in

which

the securities will be offered for sale.

B. securities that do not fall within the category of federal covered securities to be registered

simultaneously with the SEC and with the states in which the securities will be offered for sale.

C. both state-registered and out-of-state investment bankers to participate in the underwriting and

egistration of a new security issue.

D. issuers of federal covered securities to submit only a notice filing with the Administrator of states

in

which the securities will be offered for sale.

Answer: B

Explanation: Under the 2002 Uniform Securities Act, registration by coordination allows securities

that are

not federal covered securities to be registered simultaneously with the SEC and with the states in

which

the securities will be offered for sale. Federal covered securities are exempt from state registration

Colleges offering admission to displaced New Orleans students/AL-KY
See the discussion page for instructions on adding schools to this list and for an alphabetically arranged listing of schools.

Due to the damage by Hurricane Katrina and subsequent flooding, a number of colleges and universities in the New Orleans metropolitan area will not be able to hold classes for the fall 2005 semester. It is estimated that 75,000 to 100,000 students have been displaced. [1]. In response, institutions across the United States and Canada are offering late registration for displaced students so that their academic progress is not unduly delayed. Some are offering free or reduced admission to displaced students. At some universities, especially state universities, this offer is limited to residents of the area.

Great white sharks to be protected in New Zealand

Friday, December 1, 2006

The New Zealand conservation minister, Chris Carter, announced Thursday that it will be illegal in New Zealand to hunt great white sharks in New Zealand waters or in any waters with a boat carrying the New Zealand flag starting in April 2007. The decision is being hailed by conservation groups who claim the sharks would become extinct if hunting continued.

It will be illegal for a great white sharks, also known by the less common name white pointer sharks, to be hunted, possessed, killed or traded within 200 nautical miles of New Zealand according to The Wildlife Act. However if the shark was accidentally caught or killed then no prosecution will occur if they register the incident with authorities. And swimmers in Dunedin, New Zealand will also be protected by the use of shark nets.

The decision mainly comes because New Zealand signed the Convention on the Conservation of Migratory Species of Wild Animals.

Mr Carter said: “These majestic animals occur naturally in low numbers and, without protection, could be pushed to the brink of extinction. The Wildlife Act provides a strong deterrent against targeting great whites with a $250,000 fine and up to six months imprisonment as a maximum penalty.”

Kirstie Knowles, spokeswoman for Forest and Bird, said: “The sharks had been landed with an undeserved bad rap.”

Vaughan Hill wants Mr Carter to reconsider as he is the latest man in New Zealand who has survived a shark attack. Mr Hill wants the reconsideration because of fear of his children being attacked and not because he was once attacked. Mr Hill now only 35% control of one arm with the other been amputated and has scars on his back and front. Mr Hill was 23-years-old when the attack occurred 10 years ago while he was diving for p?ua, or Abalone, commercially 100 meters away from Pitt Island, “It was pretty murky water and I felt a big smack … I was looking into the eye and the jaw of the shark.”

“The last thing I thought was that I had to get another mouthful of air to fight it off, but blood overtook me.”

Mr Hill said that sharks should only be protected if they are in a “ring-fenced marine reserve.” He desribed the great white shark as “the ultimate killing machines [which] should be controlled. I want the beaches protected, and the workplace, which for divers is the sea.”

Dr Malcolm Francis, principal scientist of NIWA (National Institute of Water and Atmospheric Research), said: “Despite the sharks’ fierce reputation they were mysterious to biologists. Great whites were known to travel huge distances but their breeding and life cycles were not as well documented.”

“They are incredible predators, but they are more vulnerable than us,” Dr Francis said, “Human attacks are more likely a case of mistaken identity. They let go when they realise we’re not their normal prey (fish and seals), but often the initial bite is devastating.”

Jim Anderton, minister of fisheries, said: “The white pointer shark was not known to be targeted by commercial fishing but was occasionally taken, unintentionally, as by-catch. They were sometimes targeted by recreational fishers and there was some demand for jaws and teeth as fishing trophies. Others were unintentionally caught in set nets.”

“No one wants to see an animal hunted to extinction for the sake of a jaw or a few teeth or to be placed under pressure by accidental catch. Under these new regulations no fisher will be able to profit from taking a white pointer, and any fisher inadvertently catching one will have to return it to the sea, intact, and alive, if possible.”

In New Zealand there have only been nine reported cases of shark attacks for 16-years.

Apartment block blaze kills nine in Mississippi, US

Tuesday, December 29, 2009

A blaze at an apartment block killed nine people early yesterday morning in Mississippi, US. The dead included six young children, and the building was seriously damaged after fire broke out at 4 a.m. in Starkville.

All nine victims were in the same apartment in the two-story building, which was split into eight residences and sustained heavy damage to three of these. Firefighters had difficulty dealing with the emergency and were still there six hours after the fire began.

The youngest child was six months old and the eldest was four. No names have been released, and the disaster’s cause remains a mystery. Emergency services kept residents away while they cleaned up the scene.
